Non-Compete Clause

A non-compete clause restricts you from joining a competitor or poaching clients for a period after leaving. In the UAE it is enforceable only where you had access to clients or business secrets and the restriction is limited in time, place, and activity, capped at two years, and it cannot be enforced if you left during probation.

Do not panic at the sight of one, but do not ignore it either. Courts require the clause to be specific and reasonable, will not simply block you from working, and the usual remedy is compensation for proven loss rather than an injunction.
